1. Agreement to these Terms

These Terms of Service ("Terms") are an agreement between you and ECOMMYERS LLC, 11036 N 28th Dr, Phoenix, AZ 85024, United States, which operates the Sanctuary Faith online store at sanctuaryfaith.co ("Sanctuary Faith," "we," "us," or "our"). They apply when you visit our website, create an account, or buy from us (together, the "Services").

By using the Services or placing an order, you agree to these Terms and to the policies they reference: our Privacy Policy, Refund Policy, and Shipping Policy. If you do not agree, please do not use the Services.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. If you are younger, you may use the Services only with the involvement of a parent or guardian.

3. Your account

If you create an account, please give accurate information and keep it up to date. You are responsible for keeping your login credentials secure and for activity under your account. Tell us right away if you believe your account has been used without your permission.

4. Products

We try to describe and display our products as accurately as possible. Colors and finishes may look slightly different on your screen than in person, and measurements are approximate. If a product is not as described, your remedy is to return it under our Refund Policy.

5. Prices and availability

All prices are in U.S. dollars. Prices, products, and promotions may change at any time, but changes will not affect orders we have already accepted. Applicable sales tax and shipping charges are shown at checkout before you pay. Products are available while supplies last, and we may limit quantities.

If a product is listed at an incorrect price or with incorrect information because of an error, we may cancel any order for that product. If we cancel an order after you have been charged, we will refund the full amount to your original payment method.

6. Orders

Your order is an offer to buy. We accept your order when we ship it. Before then, we may decline or cancel an order, for example if a product is unavailable, if there is a pricing or product error, or if we suspect fraud. If we cancel your order, we will notify you and fully refund any amount charged.

7. Payment

You agree to provide a valid payment method that you are authorized to use. Payments are processed by our payment processors, including Shopify Payments, and are subject to their terms. You authorize us to charge the total shown at checkout, including taxes and shipping.

8. Shipping and risk of loss

We ship orders as described in our Shipping Policy. Title to products and risk of loss pass to you when the products are delivered to the shipping address you provided. If a package is lost in transit, marked as delivered but not received, or arrives with items missing, we will reship it or refund you as described in our Refund Policy.

9. Returns, refunds, and warranty

We offer 90-day, no-questions-asked returns and a Lifetime Limited Warranty against fading and tarnishing. The full terms are in our Refund Policy, which is part of these Terms.

10. Promotions, discount codes, and free gifts

Promotions and discount codes are subject to the terms shown with the offer. Unless an offer says otherwise, only one discount code can be used per order, codes have no cash value, and they cannot be applied to past orders. Free gifts are available while supplies last, have no cash value, and may be substituted with an item of equal or greater value. We may change or end a promotion at any time, but this will not affect orders already placed.

11. Reviews and other content you submit

If you submit reviews, ratings, photos, or other content, you confirm that it reflects your honest, first-hand experience, that you have the right to share it, and that it does not violate any law or anyone else's rights. You give us a non-exclusive, royalty-free, worldwide license to display, reproduce, and share that content in connection with the Services and our marketing, together with the name you submit it under.

We do not remove or suppress reviews because they are negative. We may remove content that is unlawful, abusive, harassing, obscene, or unrelated to the product, or that contains personal information or spam. Nothing in these Terms limits your right to post an honest review of our products or services.

12. Intellectual property

The Services and their content, including our name, logo, designs, product images, text, and graphics, are owned by us or our licensors and are protected by intellectual property laws. You may use the Services only for your personal, non-commercial shopping. You may not copy, modify, distribute, or create derivative works from our content without our written permission.

13. Acceptable use

You agree not to: use the Services for any unlawful or fraudulent purpose; place orders using information that is not yours or that you are not authorized to use; interfere with the security or operation of the Services; use bots, scrapers, or other automated tools to access the Services or buy products for resale; or upload viruses or other harmful code.

14. Third-party services and links

Our store is hosted on Shopify, and the Services may include tools or links provided by third parties. Your use of third-party services is subject to their own terms and privacy policies, and we are not responsible for third-party websites or services we do not control.

15. Disclaimers

To the fullest extent permitted by law, the website and its content are provided "as is" and "as available," without warranties of any kind, and we do not warrant that the website will be uninterrupted, error-free, or free of harmful components. This section does not limit our Lifetime Limited Warranty, any implied warranties that cannot be disclaimed under applicable law, or any rights you have under consumer protection law.

16. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of or relating to the Services or any product. Our total liability for any claim relating to a product will not exceed the amount you paid for that product. Some states do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

17. Indemnification

You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Services, to the extent permitted by law.

18. Disputes and governing law

If you have a concern, please contact us first at support@sanctuaryfaith.co. Most issues can be resolved quickly this way, and we ask that both of us try in good faith to resolve any dispute informally for at least 30 days before starting a formal proceeding.

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. Any dispute that is not resolved informally will be brought in the state or federal courts located in Maricopa County, Arizona, except that either of us may bring an individual claim in small claims court where eligible. If you are a consumer, nothing in this section removes protections you are given by the mandatory laws of the place where you live.

19. Termination

We may suspend or end your access to the Services if you violate these Terms or if needed to protect the Services or other customers. Sections that by their nature should survive termination, including those on intellectual property, disclaimers, limitation of liability, and disputes, will continue to apply.

20. Changes to these Terms

We may update these Terms from time to time by posting the new version on this page and changing the "Last updated" date. Changes apply to orders placed and use of the Services after they are posted. The Terms in effect when you place an order apply to that order.

21. Electronic communications

You agree that we may communicate with you electronically, such as by email or notices on the website, and that these communications satisfy any legal requirement that they be in writing.

22. General

These Terms, together with the policies they reference, are the entire agreement between you and us about the Services. If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any part of these Terms is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer ours in connection with a sale or reorganization of our business.
